1. The term of this Limited Warranty is one (1) year (the “Limited Warranty Period”). The Limited Warranty
Period begins on the date of product delivery to customer, whether or not actual use begins on that date.
2. Yallourn warrants to the original owner-user that this product will be free from defects in material
or workmanship for the limited warranty period only. Yallourn is NOT the manufacturer of the
product. During the Limited Warranty Period, Yallourn will, at its sole option: (i) ship back the
product to the overseas manufacturer for the manufacturer to repair the product for which all shipping charges
will be borne by the owner-user; shipping charges will be communicated to the owner-user before any cost
incurred (ii) refund the amount you paid for the product upon its return. Replacement parts and products will be
new and warranted for the remainder of the original warranty period.
3. The warranty provided herein shall be void and of no effect in the following cases:
(i) the product has been operated outside its designed application
(ii) the product has been subjected to misuse, neglect, accident, improper care, eg. extended exposure to
sunlight and heat, crack or any kinds of external damages due to improper care.
(iii) unauthorized modifications are made to the product
(iv) the product is not operated in compliance with the manufacturer’s printed instructions
(v) the serial number of the product has been altered, defaced, tampered with or removed
(vi) the product has been serviced by a party not authorized by Yallourn.
(vii) the product shows evidence of being fully/partially dismantled, tampered with, or external cover been
removed
This warranty does not cover:
(a) DAMAGES TO THE PRODUCT CAUSED BY ADVERSE WEATHER CONDITIONS SUCH AS
HURRICANES, TORNADOS, OR FLOODS; FIRE, THEFT, VANDALISM OR TERRORISM, AND, ANY
OTHER OCCURRENCE REASONABLY NOT QUALIFYING AS "GENERAL USE"
(b) DAMAGES TO THE PRODUCT CAUSED BY USAGE THAT IS NOT IN ACCORDANCE WITH PRODUCT
INSTRUCTIONS
(c) DAMAGES TO THE PRODUCT CAUSED BY FAILURE TO FOLLOW THE PRODUCT INSTRUCTIONS
OR FAILURE TO PERFORM PREVENTIVE MAINTENANCE
(d) ANY EQUIPMENT OR COMPONENTS THAT WERE NOT INCLUDED IN YOUR PRODUCT AS
ORIGINALLY SOLD TO YOU
(e) NORMAL WEAR AND TEAR
(f) COSMETIC DAMAGE THAT DOES NOT AFFECT FUNCTIONALITY
(g) MINOR IMPERFECTIONS IN UNITS THAT MEET DESIGN SPECIFICATIONS OR IMPERFECTIONS
THAT DO NOT MATERIALLY ALTER FUNCTIONALITY
THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY FOR YALLOURNS PRODUCTS,
AND IS IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES. Yallourn
SPECIFICALLY DISCLAIMS ALL OTHER EXPRESS AND IMPLIED WARRANTIES,INCLUDING, BUT NOT
LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE. NO PERSON OR ENTITY IS AUTHORIZED TO BIND Yallourn TO ANY OTHER
WARRANTY, OBLIGATION OR LIABILITY FOR ANY YALLOURN PRODUCT.
INSTALLATION, OPERATION OR USE OF THE PRODUCT FOR WHICH THIS WARRANTY IS ISSUED
SHALL CONSTITUTE ACCEPTANCE OF THE TERMS HEREOF.
Exclusions
1. Yallourn shall not be liable for any loss, cost, damage, or expense of any kind arising
out of a breach of the warranty.
2. Yallourn shall not be liable for any incidental, consequential, exemplary, special, or
punitive damages, nor for any loss of revenue, profit or use, arising out of a breach of this warranty
or in connection with the sale, maintenance, use, operation or repair of this product.
3. In no event will Yallourn be liable for any amount greater than the purchase price of a
defective product. The disclaimers of liability shall remain in effect and shall continue to be
enforceable in the event that any remedy herein shall fail of its essential purpose.
4. Installation, operation or use of the product shall constitute acceptance of the terms hereof.

5. All DEFECTIVE products must be returned within 3 days from the date of acceptance of the Delivery
Order and MUST: be 100% complete, contain ALL original boxes and packing materials, contains all
manuals, and other accessories and documentation provided by the manufacturer.
6. Yallourn reserves the rights to refuse any returns that:
(a) Has been specified as not be refundable.
(b) Is not returned in its original packaging.
(c) Has missing parts.
(d) Returns received beyond 3 days from the original date of acceptance of Delivery Order. |
